The Real Estate Council of Ontario (RECO) is seeking three Investigators. We have two permanent and one contract position available to start immediately.

The role
Under the direction of the Manager Investigations, the investigator carries out detailed investigations of persons and companies who are believed to have contravened the Trust in Real Estate Services Act, 2002 (TRESA), or its successor, and investigates alleged contraventions of any other law that would be relevant for persons or companies continued registration under the Act.
The position of investigator carries with it significant responsibility. Investigations can not only result in prosecutions/convictions in the Provincial Court, but often the results of an investigation can also lead to the revocation of an individual’s registration thereby taking away their very means of livelihood. Given the magnitude of consequences, investigations of any matters are always given very serious thought and attention.
Position responsibilities
Execution
- Conduct interviews and take statements from witnesses, potential witnesses and subjects under investigation.
- Gather all relevant facts and evidence thoroughly, fairly and objectively. The collection of this evidence may require the execution of a search warrant under the powers of Provincial legislation.
- Prepare and swear to information pertaining to charges, search warrants and summonses before a Justice of the Peace in regards to Provincial Statutes enforced by RECO. Service of summonses and other documentation to both persons and companies charged and witnesses.
- Prepare and provide the Manager with a complete and accurate prosecution brief (or brief setting out evidence in support of proceedings at a tribunal hearing) in the prescribed format.
- Liaise with RECO lawyers, the Registrar, and other staff of RECO and liaise with police and other enforcement agencies.
- Attend hearings as a witness on behalf of RECO and appear in court to speak to remands, adjournments, guilty pleas, etc. Provide testimony as is required at any hearing initiated by RECO. Provide testimony if required in a criminal court proceeding.
- Other duties as assigned.
Qualifications and experience
- Strong Investigative skills and interviewing skills.
- Broad knowledge and understanding of the real estate industry and consumer protection issues.
- Extensive knowledge of the Real Estate and Business Brokers Act and regulations, fraud related sections of the
- Criminal Code, and of the Provincial Offences Act.
- Extensive experience in the court system, legal administration, judicial and quasi-judicial proceedings.
- Understanding of the Rules of Evidence.
- Ability to understand accounting issues, good familiarity with real estate brokerage operations.
- Working knowledge of police sciences.
- Problem solving and negotiating skills.
- Excellent communication skills, oral and written.
- Working knowledge of legal documents as it would pertain to land transfers, mortgages, incorporations, etc.
- Strong accounting and analytical skills.
- Organized, disciplined and self-motivated.
- Investigative duties have no regular or routine schedule or map. Investigators must have the ability to work flexible and irregular hours when the need arises or on little or short notice.
- Investigators must be able to work under pressure and meet deadlines.
- Investigators must be able to work independently.
- Investigators must have the ability to assemble complex and large investigations into a clear and comprehensible format.
- Investigators must have exemplary verbal skills, as work requires dealings with all segments of society, be it victims, defendants, judiciaries, or peers.
